I agree, the data cost is to offset the exspence to USGS of providing the
data on tape and loading the requested files. A call to 1-800-USAMAPS should
confirm this. Once you purchase the data, it should be pd (so long as it was
purchased from USGS and not a comercial source who might have massaged the
data making it proprietary e.g. Vista Pro or WCS).
